1. Scope

This policy covers personal data the Firm collects through www.lexnks.com, including data submitted by people applying for empanelment or other roles. It does not cover data held about clients under an accepted engagement, which is governed by the engagement terms and by professional obligations of confidentiality.

We are the Data Fiduciary under the Digital Personal Data Protection Act, 2023. You are the Data Principal.

2. What we collect

When you apply through a form on this site:

  • name;
  • WhatsApp number and, if given, email address;
  • state and city of practice;
  • Bar Council enrolment number and year of enrolment;
  • the further particulars asked on the form, including any document you upload;
  • anything you volunteer in a free-text field.

Automatically: IP address, browser and device information, and the time of your submission. These are kept for security and abuse prevention, not to build a profile of you.

We do not ask for, and you should not send, details of any matter in which you are instructed, or any client's information.

3. Why we use it, and on what basis

We do not sell your data, and we do not use it for advertising.

4. Consent, and withdrawing it

You consent when you tick the box and submit the form. That consent is specific to the purposes above.

You may withdraw it at any time by writing to info@lexnks.com. Withdrawal is as easy as giving consent. It does not affect anything done before you withdrew, and we may still keep what the law requires us to keep. If you withdraw while an application is open, we will stop processing it.

5. Who sees it

  • Within the Firm: the advocates and staff assessing applications.
  • Service providers who process data for us, under contract and only on our instructions: our website and application hosting, and our messaging provider for WhatsApp communication.
  • Bar Councils and public registries, where we verify enrolment.
  • Where the law requires it, including a court order or a lawful demand from an authority.

Your personal data is stored in India. We do not transfer it to a processor outside India.

6. How long we keep it

  • Unsuccessful applications: 12 months from the decision, then erased.
  • Successful applications: for the duration of the engagement, and afterwards for as long as professional and tax records require.
  • Server and security logs: 12 months.

Under the DPDP Act we erase personal data once the purpose is served and retention is no longer required by law.

7. Your rights

As a Data Principal you may:

  • ask what we hold about you and how it has been used and shared;
  • have it corrected if it is inaccurate, or completed if it is incomplete;
  • have it erased, where we no longer need it and no law requires us to keep it;
  • nominate another person to exercise these rights if you die or become incapacitated;
  • complain to us, and then to the Data Protection Board of India if you are not satisfied.

8. Your obligations

The DPDP Act requires that you do not impersonate anyone else, suppress material information, or register a false or frivolous grievance.

9. Security

We apply reasonable security safeguards, including access control, encryption in transit, and restricting application data to those who need it. No system is perfectly secure. If a breach occurs we will notify the Data Protection Board and affected persons as the DPDP Act requires.

10. Children

This site and its application forms are not directed at children, and we do not knowingly collect their data. An applicant must be an enrolled advocate and therefore an adult.

11. Cookies

This site sets one cookie, which is strictly necessary to serve the site on its own domain. We do not use analytics or advertising cookies, and we do not track you across other websites. Some images are served by a third-party image host, which will receive your IP address in order to deliver them.
